Financial Police files complaint: two managers from Dojran and Valandovo suspected of intentional bankruptcy

The Financial Police has filed a criminal complaint with the Basic Public Prosecutor's Office in Veles against A.K., in his capacity as owner and manager of a legal entity from Valandovo (and the legal entity itself), and against J.T., manager of a separate legal entity from Dojran, on grounds of suspicion for the crime “Intentional causing of bankruptcy” under Article 254 of the Criminal Code of the Republic of North Macedonia.

According to the collected evidence, investigators believe that A.K., acting as owner, manager and authorized signatory between 2020 and 2023, intentionally sought to avoid payment of financial obligations to several legal entities — predominantly to a foreign legal entity in the amount of 289.617.022 denari — and also to the Public Revenue Office for 883.283 denari, by taking unlawful measures aimed at creating the appearance of financial incapacity and thus blocking creditors from collecting the debts.

To create an apparent legal basis for encumbering the company’s assets, A.K. signed a lease agreement with another legal entity he also controlled. The contract was allegedly never actually carried out nor recorded in the accounting records; after A.K. unilaterally terminated it in 2023, penalties in the amount of 233.700.000 denari were recorded and a charge was registered against the company’s property. Creditors lodged objections and the Basic Civil Court Skopje issued a temporary injunction halting enforcement.

When efforts to sell off real estate failed, the complaint states, A.K., with the assistance of J.T., took further steps intended to push the company into bankruptcy. Among those moves were transfers of 4.000.000 denari characterized as a loan — funds that had earlier been received from a legal entity established by the first defendant’s wife — after which a proposal to open bankruptcy proceedings was submitted against the company.

Next steps in the procedure

The criminal complaint has been submitted to the Basic Public Prosecutor's Office in Veles, which will review the materials and decide whether to bring formal charges and pursue prosecution. The Financial Police says the measures reflect suspected deliberate conduct to frustrate creditor recovery.

No court conviction has been made; the allegations in the complaint remain to be proven in court.
