Supreme Court annuls convictions in Modular Hospital Tetovo case

The Supreme Court of the Republic of North Macedonia annulled the convictions in the case known publicly as the "Modular Hospital Tetovo" and returned the file for a new trial before the Basic Court Tetovo.

The decision was reached by the Court's Council for Criminal Offences at a session held on 22 October 2026, after the convicted persons, through their defence counsel, filed requests for an extraordinary review of the final judgment.

In an official statement the court quoted the Council: "The Council for Criminal Offences at the Supreme Court of the Republic of North Macedonia, at the session held on 22.10.2026, rendered a judgment in case KVP2-36/26 (publicly known as the Modular Hospital Tetovo), by which it granted the requests for extraordinary review of the final judgment of the convicted persons, submitted through their counsels."

Which rulings were overturned

With the Supreme Court's ruling, the judgment issued by the Basic Court Tetovo on 16 May 2025 and the appellate decision of the Appellate Court Gostivar dated 26 November 2025 were both set aside. The case will therefore return to first-instance consideration.

The Supreme Court also dismissed as inadmissible the request for extraordinary review submitted by the legal entity JZU Clinical Hospital Tetovo. The retrial will be conducted before the Basic Court Tetovo, which must now re-examine the charges and evidence under the procedural framework set by the higher court's decision.
