Судскиот совет и Здружението на судиите реагираа по чекорот на Уставниот суд

Судскиот совет и Здружението на судии со предупредување за заштита на независноста на судството, откако Уставниот суд го активира механизам за одговорност против судија по предмет поврзан со новинари од „крвавиот четврток“.

Judicial self-governing bodies in North Macedonia have publicly protested after the Constitutional Court used a rarely used accountability mechanism against a judge who, the Court found, failed to implement its ruling in a case connected to press freedom.

The Judicial Council of the Republic of North Macedonia and the Association of Judges said they respect the constitutional status of the Constitutional Court and the finality of its decisions, but warned that the independence and procedural autonomy of ordinary courts must also be protected.

Background and contested ruling

In their joint reaction they pointed out that the Basic Civil Court in Skopje decision is not final and is subject to appeal before the competent appellate court, and that institutional steps connected to a non-final ruling require particular care so as not to create an impression of prejudging the outcome or exerting pressure on the judges deciding the case.

“-Во конкретниот случај, Решението П4-240/22 од 4 мај 2026 година на Основниот граѓански суд Скопје не е правосилно и против него е изјавена жалба за која треба да одлучува надлежниот второстепен суд. Оттука, постапката сè уште е во тек, а оценката на законитоста на првостепената одлука му припаѓа само на надлежниот второстепен суд. Во такви околности, Судскиот совет на Република Северна Македонија и Здружение на судиите на Република Северна Македонија сметаат дека секое институционално постапување поврзано со конкретната неправосилна судска одлука бара особена внимателност и воздржаност, за да не се создаде впечаток на прејудицирање на исходот од постапката или на притисок врз судиите кои одлучуваат во конкретниот предмет. Независноста на судството не е привилегија на судиите, туку гаранција за граѓаните дека за нивните права и обврски ќе одлучува независен и непристрасен суд. Функцијата на судовите не се состои во извршување на одлуки на други државни органи, туку во самостојно и независно судење врз основа на Уставот, законите и ратификуваните меѓународни договори. Оттука, ниту еден орган, без оглед на неговата уставна положба, не може да определува или да прејудицира каква одлука треба да донесе судот во конкретен предмет – се вели во реакцијата.

They also stressed that respect for the Constitutional Court and respect for the independence of ordinary courts are part of the same constitutional order and the rule of law.

“-Судскиот совет на Република Северна Македонија и Здружението на судиите на Република Северна Македонија остануваат цврсто определено за доследно почитување на Уставот, законите и одлуките на Уставниот суд, но и за бескомпромисна заштита на независноста на судската власт, правото на правично судење и непреченото функционирање на системот на правни лекови. Само преку институционална воздржаност, заемно почитување на уставните надлежности и доследно почитување на законските процедури може да се обезбеди владеење на правото и да се зајакне довербата на граѓаните во институциите – се додава во реакцијата.

The dispute follows a rare step by the Constitutional Court, which said it had activated an accountability mechanism after finding that a judge at the Basic Civil Court ignored the Court’s order to repeat proceedings in a case brought by journalist Natasha Stojanovska, one of the reporters who has ongoing lawsuits related to the violent entry into Parliament on 27 April 2017.

According to the Constitutional Court, the judge relied on provisions of the Law on Civil Procedure and argued that a Constitutional Court decision cannot serve as a basis for repeating proceedings as a new fact or evidence. The Constitutional Court found that the judge failed to take into account the constitutional legal characteristics and legal effect of Constitutional Court decisions — their finality, enforceability and general binding force — and therefore did not implement the Constitutional Court’s ruling.

The Constitutional Court recalled earlier practice in which, after Decision U.бр.146/2021 of 12 July 2023, the Basic Civil Court in Skopje accepted that a Constitutional Court decision could be treated as a new fact and new evidence and used it as a ground for reopening the closed case MALVP-705/20 of 14.04.2021, a position later upheld by the Appellate Court of Skopje with Decision GŽ-118/24 of 07.11.2024. The Constitutional Court said it had therefore reported the judge to the Public Prosecutor’s Office and to the Judicial Council for failing to carry out its decision.

The Constitutional Court’s intervention is part of a wider effort to give legal effect to rulings that have recognised violations of freedom of expression suffered by journalists during the events of 27 April 2017, when reporters covering the attack were exposed to threats and violence and many of their civil claims have been dismissed or left without judicial resolution for years.

Journalists today filed lawsuits over the attacks they suffered on 27 April in Parliament, a step that comes amid renewed scrutiny of how courts have handled these claims.
