Constitutional Court to review linear pension-adjustment clause and other initiatives

The Constitutional Court will today examine several initiatives seeking review of the constitutionality and legality of laws and subordinate acts, including a contested provision of the Law on Pension and Disability Insurance that provides for a linear adjustment of pensions.

According to the petitioners, the contested provision, which concerns the period from 1 September 2025 to 31 March 2026, suspends the application of Article 37 of the Law, which envisages pension adjustments based on wage growth and inflation.

The initiatives state that a linear increase — that is, an identical nominal rise for all pensioners — fails to take into account the level of the pension, previous pension-contribution payments and years of service. Petitioners argue that this approach gives pensioners with lower pensions a relatively larger percentage increase than those with higher pensions, amounting to unequal treatment of pensioners contrary to the constitutional principle of equality and the prohibition of discrimination.

The judges will also consider an initiative concerning part of the Law on Public Cleanliness, where the petitioner alleges the provision is unclear in its determination to "'protect' only the 'central area of the municipalities, the municipalities in the City of Skopje and the city of Skopje'." They will also hear an initiative on provisions of the Law on Construction and the Law on the City of Skopje related to annulment of permits for installing urban equipment.

Other items on the agenda

On the court's agenda are initiatives to review a resolution condemning manipulations by the opposition and to confirm policies against illegal migration, the Program for basic geological research for 2026, a decision linked to the tariff for compensations in technological-industrial development zones, and a decision on an urban plan in the Municipality of Tetovo.

In addition to these initiatives, the Court will consider requests for protection of citizens' freedoms and rights concerning prohibition of discrimination on grounds of social origin, as well as requests for protection of the freedom of thought and public expression of opinion.
