Prosecutor Jovan Cvetanovski to give opinion in Talir 2 appeal
The senior prosecutor who asked to annul the 2023 verdict will now provide an opinion to the Appellate Court on the prosecution's appeal in the Talir 2 case.

Prosecutor Jovan Cvetanovski has been assigned to provide a legal opinion to the Appellate Court in the "Talir 2" case, the decision in which will determine whether the ruling to confiscate the ruling party VMRO‑DPMNE's property will stand. The file reached the Appellate Court last week after the public prosecutor's office appealed an acquittal in the criminal proceedings against the party's former leader.
Cvetanovski is the same senior prosecutor who, in 2023, represented the prosecution at the Appellate Court and sought annulment of the first‑instance verdict that sentenced former prime minister Nikola Gruevski to six years in prison and ordered confiscation of the party headquarters. He told reporters he will deliver his opinion to the Appellate Court within a day or two on whether his colleague's appeal from the Skopje prosecution is well founded.
Why his involvement matters
When the case was before the Appellate Court in 2023, Cvetanovski argued that the court had erred in how it assessed proportionality and that it had overstepped into economic and market judgements, asking for the judgment to be set aside and the case returned for retrial while taking into account amendments to the Criminal Code. He said then: "Судот погрешно се впуштил во оцена на несразмерноста на процентите, но заклучокот не го заснова на регулираната норма. Судот се вклучува во ценење на стопански и економски дејствија на пазарот со недвижности. Судот не прави разлика меѓу јавна набавка и јавна услуга. Предлагаме предметот да се врати на повторно судење и да се отстранат констатираните повреди. Да се земат предвид измените на КЗ за членот 353 и да се примени, со што настапува апсолутна застареност на делото."
Under procedural rules, the Appellate Court can confirm or overturn the first‑instance ruling, annul it and order a public hearing, or return the case for retrial. Meanwhile, the contested party property remains frozen until there is a final court decision.
Legal experts say the prosecution's appeal to the Appellate Court is the state's last ordinary remedy to try to secure confiscation of the party's property; yet there are other, more complex pathways should the case lapse. Darko Avramovski, director of the Coalition "All for Fair Trials", warned that alternative mechanisms are legally possible but practically difficult. He said: "Доколку настапи застареност, тоа само по себе не значи дека автоматски се исклучува можноста за конфискација. Постојат посебни механизми преку кои може да се отвори прашањето за одземање имот и без осудителна пресуда, преку одредбите на Законот за кривичната постапка (ЗКП) за конфискација без осудителна пресуда, како и преку Законот за конфискација на имот во граѓанска постапка, доколку се исполнети условите предвидени со закон. Меѓутоа, голем проблем е практичната применливост на овие механизми. ЗКП предвидува можност за конфискација без осудителна пресуда, но постапката не е доволно детално разработена, односно недостигаат јасни процесни правила за начинот на нејзиното водење, доказните прашања и процесните гаранции, што создава сериозни дилеми за нејзината практична примена. Од друга страна, Законот за конфискација на имот во граѓанска постапка беше замислен токму како дополнителен механизам за ситуации во кои имотот не може да биде одземен преку редовната кривична постапка. Меѓутоа, уште при неговото донесување, предупредувавме дека начинот на кој е поставена постапката ќе создаде сериозни проблеми во примената. Досегашните резултати се исклучително скромни, а токму практичните проблеми во поведувањето и водењето на постапките се една од причините поради кои веќе се работи на промена на законската рамка."
One concrete deadline adds pressure: if the Appellate Court does not issue a decision before August 31, the criminal statute of limitations could extinguish the regular criminal route to confiscation. Amendments to the Criminal Code in 2023 that reduced some penalties have already shortened limitation periods, making it less likely the prosecution will achieve a final conviction and confiscation before time runs out. Commenting after the acquittal in the criminal trial, Ristoska said: "„Талир 2“ ми беше одземен за да се спаси имотот на ВМРО-ДПМНЕ".
